Senior Jurists to the Knesset: "There is a Danger"

After the leak of the draft opinions of the High Court of Justice judges on the cancellation of the Clause of Reasonability, a number of senior jurists, including the deputy Attorney General, appealed to the Knesset to allow the High Court to postpone the publication date of the Reasonability verdict.

After the leak of the draft opinions of the High Court of Justice judges on the cancellation of the Clause of Reasonability, a number of senior jurists, including the deputy Attorney General, appealed to the Knesset to allow the High Court to postpone the date of publication of the verdict on the Clause of Reasonability.

Among other things, the jurists propose legislation for a temporary injunction that would allow publication even after the retirement date of Judges Hayut and Baron so that the result of the judgment will not change. Among the jurists who signed the letter: Prof. Yuval Elbashan, Prof. Netta Barak-Corren, Prof. Shachar Lifshitz, Prof. Danny Friedman, Adv. Raz Nazri, Prof. Yedidia Stern.

"The events of October 7 and the war that broke out in their aftermath shake the hearts of all Israeli citizens. These days our sons and daughters, from all parts of the nation and voters of all parties, are fighting a cruel enemy. Many families have lost their loved ones and others are standing by the beds of the wounded in battle.

"The publication of the verdict while the war is being waged at high intensity - when the supporters of the reform and its opponents are fighting and risking their lives together - is not desirable. There is a danger that it will harm the brave alliance that unites both the reserves and the front since the outbreak of hostilities," it said.

"The requested solution is a quick amendment of the provision of the law and the establishment of a temporary order according to which the three-month period will be extended to a longer period of six or nine months," it says. "Thus, on the one hand, the panel that discusses the issue will be able to make a decision on the matter, and on the other hand, the court will not be "bound" to the schedule that requires publication during the fighting. The agreement of the heads of the parties can lead to the completion of this legislation within days."
