Appeal to Foreign Judge and Recommendation of Attorney General: Behind Appointment of Barak

The President of the Supreme Court was appointed to be the judge on behalf of Israel in the expected hearing of South Africa's claim that Israel is committing "genocide". The appointment came from the recommendation of the Attorney General and the consent of the Prime Minister.

The appointment of the former president of the Supreme Court creates a lot of discussion in the political system and on the networks, according to publications the appointment was approved by Prime Minister Netanyahu after an appeal was made to a senior American judge to consider the possibility of representation on his behalf which did not materialize.

Former Supreme Court President Aharon Barak was appointed to be a judge on behalf of Israel who sat as part of the hearing of the Court of Justice in The Hague, regarding South Africa's complaint against Israel to the court on the grounds that Israel is committing "genocide" against Palestinians in the Gaza Strip.

The appointment of the former president created a lot of discussion, the former president Barak is seen in right-wing circles as a controversial figure. Being the one who, during his tenure as president, was the leader and founder of the extreme judicial activism approach that exists today in Israel. On the other hand, the appointment provoked satisfied reactions from figures from the political left and supporters of judicial activism in Israel.

According to the publication of Amit Segal in N12 news, Barak's appointment came to fruition after Israel approached a particularly senior judge in the United States in the hope that he would agree to represent Israel in the trial, and act on its behalf as a judge in the hearing on the South African lawsuit, but this did not come to fruition.

According to other publications, Attorney General Gali Baharav-Miara is the one who recommended to Prime Minister Netanyahu to appoint retired Supreme Court President Aharon Barak to the position, and Prime Minister Netanyahu accepted her recommendation.
