Feldstein’s Release Raises Questions About Justice and Selective Enforcement

Supreme Court ruling: Eli Feldstein released to house arrest, Sergeant A remains in custody

The Supreme Court ruled that Eli Feldstein will be released to house arrest because Jonathan Urich, who committed the same acts, is walking free, raising concerns about selective enforcement. In contrast, the unidentified officer will remain in custody due to concerns that he might disclose additional classified materials.

After the prosecution's appeal against the expected release of Eli Feldstein and Sergeant A, which was determined in the district court, the Supreme Court decided to release Feldstein to house arrest and Sergeant A will remain in custody.

Regarding the defendant, the court ruled: "Therefore, the state's appeal regarding the defendant is accepted, and the defendant's appeal is hereby rejected." The defendant will remain in custody, subject to a change in circumstances.

The reason the defendant will remain in custody is the fear that he will disclose additional classified materials he has been exposed to, and not due to trial tampering or flight, as reported by Dafna Liel.

And regarding Feldstein, it was determined: "The state's appeal in Feldstein's case is hereby rejected, subject to the enhancement of the conditions for his release from detention, primarily electronic monitoring outside the prison."

From the analysis of the ruling, it appears that the decision to release Feldstein was because he was exposed to a limited number of classified information, which he transferred to Jonathan Urich. And according to the judge, there is no reason for Urich to roam free while Feldstein remains in custody, as reported by Michal Shemesh.

But contrary to the district court, Supreme Court Justice Alex Stein rules that there is evidence that Feldstein committed an offense with the intent to harm the state, as reported by Amit Segal.
